Ratio Decidendi

The respondent's employment was terminated by reason of redundancy as the employer unilaterally placed him on temporary relief without pay and subsequently attempted to demote him without justification. However, as a management employee under a written contract, the respondent was only entitled to redundancy benefits as stipulated in his contract, not under the Minimum Wages and Conditions of Employment Act or its General Orders. Salary was not payable during the period of temporary relief after redundancy took effect.
