Where both parties to a contract executed outside Zambia do not dispute its execution or genuineness, authentication under the Authentication of Documents Act is not required for its use between them in Zambian courts. Further, the Zambian court is the appropriate forum as the agreement and parties have their closest connection to Zambia, and the Defendant failed to demonstrate that South Africa is a more convenient forum.
