Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the selection and installation of the 1st and 2nd appellants as Chief Mwenda complied with Chishinga customs and traditions
  2. 2 Whether the Chikwa Nambale lineage is eligible to ascend to the throne given the alleged curse and ban
  3. 3 Whether the lower court erred in its findings regarding the eligibility of the appellants and the proper procedure for succession

Ratio Decidendi

The selection and installation of both appellants as Chief Mwenda were contrary to the customs and traditions of the Chishinga people, as the required agreement among the three lineages and selection by queen mothers did not occur, and the Chikwa Nambale lineage remains banned from succession until the curse is lifted. The Kaunda lineage is next eligible to provide a successor. The lower court did not err in its findings or in declining to sit with assessors.

Court Disposition

Appeal dismissed

Orders

  • It is the Kaunda family's turn to rule; the next Chief Mwenda should be chosen from the Kaunda lineage.
  • The traditions and customs of selecting and installing the Chief must be complied with.
