Ratio Decidendi

The appellant failed to prove to the requisite standard that the majority of voters in Kamfinsa Constituency were or may have been prevented from electing their preferred candidate as a result of the 1st respondent's alleged electoral malpractices. While some rallies in government buildings and supply of cows to inmates were proved, there was no cogent evidence that these acts were widespread or influenced the majority. The trial court applied the correct standard of proof and its findings were supported by the evidence. Allegations against the 2nd respondent were also not proved to the required standard.
