Ratio Decidendi

The plaintiff failed to prove on a balance of probabilities that she is the biological daughter of the deceased, as she did not produce any documentary or scientific evidence to establish paternity. Consequently, she is not a beneficiary of the estate. Further, the claim is statute barred under Section 20 of the Limitation Act, 1939, as it was brought more than twelve years after the deceased's death. There was also no credible evidence that the deceased left the assets alleged by the plaintiff.
