Ratio Decidendi

The High Court of Zambia has no jurisdiction to hear a petition for dissolution of a marriage contracted under Sunni Muslim law, as such a marriage is neither solemnized under the Marriage Act nor under the law of a foreign state. Jurisdiction cannot be conferred by parties' submission or consent, and the Matrimonial Causes Act expressly excludes marriages contracted under customary or religious law from its ambit.
