Procedural Posture

Civil Appeal / Supreme Court Judgment

  1. 1 Whether the appellants are the legal owners of the land and school in question
  2. 2 Whether the trial judge erred in ordering sub-division and issuance of a separate title deed to the community school
  3. 3 Whether the appellants ceded ownership to the community

Ratio Decidendi

The appellants are the legal and proprietary owners of the land and school in question by virtue of a valid certificate of title, as the respondents neither pleaded nor proved fraud or mistake. The trial judge erred in ordering sub-division and issuance of a separate title deed to the community school, as such an order is not supported by law or facts and is incapable of enforcement. The respondents’ claim of ownership is unsupported by documentary evidence, and the establishment of a parents’ committee or registration as a community school does not amount to ceding of ownership by the appellants.

Court Disposition

Appeal allowed (except on locus standi); trial court order set aside

Orders

  • Order for sub-division of land and issuance of separate title deed to the community school is set aside
  • Appellants confirmed as legal and proprietary owners of the land and school
