Procedural Posture

Labour/employment Dispute / Judgment

  1. 1 Whether the complainants' dismissal from employment was wrongful
  2. 2 Whether the complainants' dismissal from employment was unfair
  3. 3 Whether the complainants are entitled to damages for loss of employment

Ratio Decidendi

The complainants' dismissal was not wrongful or unfair as the respondent followed disciplinary procedures, provided opportunity to be heard, and the complainants participated in an illegal strike without following statutory procedures. The respondent was justified in dismissing the complainants for valid reasons. Claims for reinstatement, damages, payment of benefits for the whole contract period, and pension benefits for 2009-2014 were dismissed as the complainants did not meet qualifying criteria and awarding such would amount to unjust enrichment.
