Ratio Decidendi

The Plaintiffs, as sitting tenants and employees of ZCCM subsidiaries or seconded to clubs/business ventures, had a superior right to purchase the houses they occupied, in accordance with government policy and Supreme Court authority. ZCCM's sale of houses to non-sitting tenants was contrary to the directive and rules. Title deeds issued to non-sitting tenants must be cancelled, except for bona fide purchasers for value without notice (4th Defendant), who are protected in equity. Defendants' counter-claim fails.
