Procedural Posture

Criminal / Judgment

  1. 1 Whether the accused persons caused the death of the deceased with malice aforethought
  2. 2 Whether the identification of the accused was reliable
  3. 3 Whether possession of the deceased's property shortly after the crime supports an inference of guilt

Ratio Decidendi

The prosecution failed to prove beyond reasonable doubt that A1 and A2 were correctly identified as the assailants due to the risk of honest mistake, intoxication, and lack of corroboration. There was no other evidence linking A1 and A2 to the crime. However, A3 and A4 were found in recent possession of the deceased's phone and memory card shortly after the assault, and their explanations were not reasonably possible. The circumstantial evidence against A3 and A4 was cogent and left no reasonable doubt as to their guilt. The assault and theft were directly connected to the death, fulfilling the requirements for murder with malice aforethought.

Court Disposition

A1 and A2 acquitted; A3 and A4 convicted of murder

Orders

  • A1 and A2 are found not guilty and acquitted; they are to be released forthwith.
  • A3 and A4 are found guilty of murder contrary to section 200 of the Penal Code, Chapter 87 and convicted accordingly.
