Ratio Decidendi

The termination of the Complainant's contract was unlawful as the Respondent failed to provide valid reasons at the time of termination as required by Section 52(1) and (2) of the Employment Code Act. However, the termination was not wrongful since notice was given per contract. The Complainant was not declared redundant, and is not entitled to redundancy benefits, damages for mental distress, or costs. He is entitled to damages for unlawful termination equivalent to 12 months' basic salary, less any payment in lieu of notice, with interest as specified.
