The appellant was given sufficient opportunity to participate in the proceedings but failed to do so due to its own lack of diligence and failure to instruct counsel. The trial court was entitled to proceed in the appellant's absence. The evidence established that the missing tobacco was traced to the appellant's premises, and the appellant obstructed further investigation. The award of the value of all missing bales was justified on the balance of probabilities. The application to set aside judgment was properly dismissed due to inordinate delay. The appellant did not acquire good title to the tobacco as it was not purchased in market overt and was stolen property.
