Ratio Decidendi

The Supreme Court held that the loan agreement, together with delivery notes and the farmer's statement, constituted a valid and enforceable contract obliging the respondent to deliver tobacco to the appellant. The respondent's brother, acting as farm manager, validly signed the agreement on his behalf. The appellant was entitled to collect the tobacco, and the respondent failed to prove his claim for conversion or that the appellant took more than 500 kg. The counter-claim for US$1,520.00 was proved, and the respondent's cross-appeal failed. The matter was referred to the Deputy Registrar to determine the value of the 500 kg of tobacco.

Court Disposition

Appeal allowed; cross-appeal dismissed.
