Ratio Decidendi

The Deputy Registrar erred in law by failing to consider the respondent’s duty to mitigate damages and by awarding damages for loss of use for an excessive period. The award of interest on the US dollar sum was also contrary to law. The proper period for loss of use is six months, and interest on the US dollar sum should be at LIBOR or 6%, whichever is less.
