Ratio Decidendi

The High Court erred in granting a vesting order in favour of the Respondents as there was no documentary or credible evidence to support their claim to Subdivision 2 of Farm No. 288a, nor proof of a constructive trust. The findings of fact were perverse and unsupported by evidence. The certificate of title in Mr. Ngulube's name was not impugned by fraud or impropriety, and the requirements for a vesting order under Section 14 of the High Court Act were not met.
