Ratio Decidendi

The respondent failed to follow its own disciplinary procedure by verbally suspending the complainant without a charge or letter, did not serve the dismissal letter, and did not attempt to contact the complainant at his residence. The complainant was not given an opportunity to be heard. The dismissal was therefore wrongful and unfair. However, reinstatement is not appropriate as the complainant found alternative employment, so damages are awarded for the period of unemployment.
