The complainant was not given a valid, substantiated reason for dismissal nor an opportunity to be heard, rendering the summary dismissal unfair and unlawful. The conditions of service of Chipata Bible College did not apply as the complainant was not its employee. The complainant is not entitled to outstanding allowances or terminal dues, but is entitled to damages for unfair dismissal. The respondent's claim for refund of unauthorised payments was not properly pleaded and cannot be granted.
