Procedural Posture

Criminal Appeal / Judgment on Appeal From Conviction and Sentence

  1. 1 Whether the trial judge erred in failing to treat prosecution witnesses as accomplices or witnesses with an interest to exculpate themselves
  2. 2 Whether the trial judge erred in failing to consider the evidence against each appellant and each overt act individually
  3. 3 Whether the trial judge failed to address conflicts and inconsistencies in the evidence and failed to consider defence alibis

Ratio Decidendi

The convictions could not stand due to fundamental misdirections by the trial judge: failure to treat prosecution witnesses as accomplices or suspect witnesses, failure to consider the evidence against each appellant and each overt act individually, failure to address inconsistencies and alibi evidence, and denial of a fair trial by refusing to tender prosecution witnesses for cross-examination. The prosecution evidence was unsatisfactory, and the trial was manifestly unfair.
