Ratio Decidendi

Section 36(1) of the Matrimonial Causes Act is clear that if a party to a marriage dies intestate while a decree of judicial separation is in effect, the estate devolves as if the surviving spouse had predeceased the deceased. Therefore, the respondent was not entitled to a share as a surviving spouse, and the trial court erred in its interpretation and in appointing her as co-administratrix on that basis.
