Order 11 of the High Court Rules, as amended by SI 58, no longer provides for conditional memorandum of appearance. A defendant wishing to challenge the writ for irregularity or want of jurisdiction must now file a memorandum of appearance and defence, then promptly apply to set aside the writ. The lower court erred in holding otherwise and in dismissing the appellant's application to set aside the conditional appearance.
