Ratio Decidendi

The claim for unlawful termination of employment is statute barred as it was not commenced within six years from the date of dismissal (27th July, 2013). The claim for malicious prosecution is not statute barred as the cause of action accrued upon acquittal on 7th September, 2018, and the suit was filed within the applicable limitation period. Civil and criminal proceedings may proceed concurrently, and the Plaintiff should have commenced the employment claim within the limitation period and applied for a stay if necessary.
