Ratio Decidendi

The Respondents are indebted to the Applicant under the restructured loan facility, secured by valid equitable mortgages over Stand No. 11189 and Stand No. 12778 Lusaka. The Applicant's claim is within the limitation period. The Applicant is entitled to foreclosure and possession of the mortgaged properties, and to enforce the personal guarantees if the sale proceeds are insufficient. Interest is chargeable as contractually agreed, and the Respondents' defences regarding lost title deeds, lack of registration, and alleged regulatory breaches are without merit.
