Ratio Decidendi

The respondents, by their conduct in applying for and accepting separation under the revised formula, accepted the variation to the conditions of service. The trial judge erred in ordering recalculation of benefits on the old factors, as the respondents had accepted the new terms. The group that left on early retirement did not raise an issue with the revised formula, and their claim for payment under the Voluntary Separation Scheme was untenable.

Appeal allowed; judgments of the trial court and Court of Appeal reversed.
