Ratio Decidendi

There was no evidence that the complainants accepted the retirement package in lieu of notice; therefore, unionised employees are entitled to one month's pay in lieu of notice and non-unionised employees to three months' pay. The complainants are entitled to profit sharing unless the employer can prove payment. Claims for employer's pension contributions and long service awards fail due to lack of entitlement under the relevant rules and lack of evidence, respectively.
