Civil Appeal / Judgment on Appeal

  1. 1 Whether 'pay' or 'salary' in the relevant agreements means basic salary and allowances
  2. 2 Whether retirement and repatriation benefits should be calculated on basic salary plus allowances
  3. 3 Whether payment under both clauses amounts to unjust enrichment

Ratio Decidendi

The terms 'pay' and 'salary' in the relevant agreements, where not expressly defined as 'basic salary', must be interpreted to include allowances. The lower court correctly found that retirement and repatriation benefits for both unionized and non-represented employees should be calculated on the basis of salary plus allowances. Clauses 8 and 9 of the Terms and Conditions for non-represented staff are distinct, and payment under both does not amount to unjust enrichment.
