Ratio Decidendi

The Court found that Corpus Legal Practitioners, by attending the Board Meetings as legal advisers to the 7th Defendant, did not become likely witnesses nor were they responsible for the disputed course of action. The advice given was not confidential as the Minutes were in the public domain, but this did not create a conflict of interest or professional embarrassment under Rule 33 (1) (d) and (e). Therefore, there was no basis to order recusal.
