Ratio Decidendi

ZESCO, as the employer and party to the contract, is liable for damages for wrongful dismissal, not the Attorney General. Payment of gratuity did not preclude damages for wrongful dismissal, but the award of 24 months' salary for unfair dismissal was set aside as the facts did not support unfair dismissal. The award of 9 months' salary for wrongful dismissal was upheld due to the traumatic manner of termination. The 1st respondent was not entitled to leave pay as he had abandoned the claim. ZESCO is liable for costs in the lower court.
