Ratio Decidendi

The Plaintiff was lawfully retired under section 28 of the Local Authorities Superannuation Fund Act for purposes of reorganization and efficiency, not redundancy. The High Court misdirected itself in finding unlawful termination and awarding twelve months salary as damages. There were no exceptional circumstances or evidence of bad faith to justify damages for mental distress. The Plaintiff had already received all benefits due under the Act, and her subsequent re-employment negated claims for future job loss.
