Ratio Decidendi

The forfeiture of the plaintiff’s mining claims was unlawful because the administrative authority failed to comply with the requirements of the Administrative Justice Act, specifically the duty to give adequate notice and an opportunity to be heard before forfeiture. The forfeiture was not automatic under s 260 of the Mines and Minerals Act, and the subsequent issuance of Special Grant No 7321 was also void as it was based on the unlawful forfeiture. Plaintiff had locus standi as the legal successor to the registered owner of the claims.

Plaintiff’s claim granted with costs

  • Forfeiture Notice No. 1 of 2019 and Forfeiture Notice No. 2 of 2019 in respect of the specified mining claims are cancelled.
