Procedural Posture

Chamber Application for Reinstatement of Appeal / Ruling on Application to Reinstate Appeal Struck Off the Roll

  1. 1 Whether the application for reinstatement of an appeal struck off the roll is competent under Practice Direction No. 3 of 2013 or Supreme Court Rules, 2018
  2. 2 Whether the grounds of appeal were fatally defective and incapable of reinstatement
  3. 3 Whether the applicant followed proper procedure in seeking reinstatement

Ratio Decidendi

The application for reinstatement was fatally defective as it sought to reinstate an appeal that was itself fatally defective and struck off the roll by consent. Practice Direction No. 3 of 2013 does not permit reinstatement of such an appeal; the proper remedy is condonation and extension of time. The grounds of appeal were vague, generalized, and embarrassing, and thus incapable of reinstatement. The application was therefore struck off the roll.
