Ratio Decidendi

The Council had no authority under the Church Constitution to remove Mai Megi from the office of President, as the Constitution provides that the President is the leader for life and the removal provisions for office-bearers do not apply to the President. The purported removal was therefore unconstitutional and invalid. The constitutional amendment filed in 1992 could not be declared null and void on the evidence. Chivese had locus standi as a member to bring the proceedings but was not entitled to the relief sought.
