Ratio Decidendi

Redan Petroleum (Pvt) Ltd, despite being the owner, was not entitled to repossess the premises by self-help without a court order. Croco Motors (Pvt) Ltd was in peaceful and undisturbed possession prior to 1 September 2015 and is entitled to a spoliation order. The giving of notice to vacate does not constitute disturbance of peaceful possession. The reliefs sought by the parties are mutually exclusive; granting one precludes the other.
