Procedural Posture

Civil Appeal / Judgment on Appeal

  1. 1 Whether the High Court had jurisdiction to review the recommendations of a Tribunal and the subsequent decision of the President removing a judge from office
  2. 2 Whether the relief sought against the President falls within the exclusive jurisdiction of the Constitutional Court

Ratio Decidendi

The High Court does not have jurisdiction to set aside the President's decision to remove a judge from office where the relief sought would require a finding that the President failed to fulfil a constitutional obligation; such matters fall within the exclusive jurisdiction of the Constitutional Court under s 167(2)(d) of the Constitution. The appellant failed to properly plead a constitutional basis for the relief sought, and the High Court's jurisdiction was ousted by the constitutional framework.
