They then fraudulently resold and transferred the property to the 3rd defendant. The 3rd defendant was notified of the plaintiff’s prior interest before transfer and is not a bona fide purchaser. The law of double sale applies, and the equities do not favour the 3rd defendant. The plaintiff is entitled to specific performance and transfer of the property.
