The plaintiff's claims are prescribed as the cause of action arose in 2017 or 2018 when the mining claims were not transferred to the company as agreed and were instead transferred to the third defendant. The plaintiff failed to perfect his rights in the claims within the statutory period required by section 275 of the Mines and Minerals Act. There was no valid acquisition of the claims by the plaintiff at law, and he has no title to challenge the transfer. The second claim for payment falls away as it is dependent on the first claim.
