The applicant, as first purchaser, only acquired personal rights against the first respondent and cannot enforce transfer against the third respondent or possession against the second respondent due to lack of contractual relationship. The second respondent, as bona fide purchaser in occupation, who paid a higher price and made improvements, established special circumstances tilting the balance of equities in his favour. Therefore, the second respondent is entitled to transfer of the property.
