The plaintiff failed to prove trademark infringement as the only similarity was the word 'luv', over which neither party had exclusive rights. The marks, when considered as a whole, were not sufficiently similar to cause confusion among average consumers. The plaintiff also failed to prove goodwill or reputation necessary for a passing off claim. Accordingly, both claims were dismissed.

Plaintiff’s claim dismissed with costs to the 1st defendant.
