Ratio Decidendi

The plaintiff entered into a valid agreement of sale with the late Gross Milanzi in 1985, paid the full purchase price, and has occupied the property since then. The 1st and 3rd defendants sold and transferred the property with full knowledge of the plaintiff's prior rights. The 3rd defendant was not an innocent purchaser and failed to prove special circumstances to disqualify the plaintiff from specific performance. The plaintiff is entitled to transfer and occupation of the property.
