Ratio Decidendi

Section 186 is a term-limit provision. The amendment extending the retirement age of judges and the Chief Justice to 75 years is an amendment to a term-limit provision and, by operation of section 328(7), cannot benefit incumbents who held office before the amendment. Any purported extension of tenure for such judges is null and void. The continued occupation of office by the Chief Justice and other affected judges beyond 70 years violates applicants' rights to equal protection and access to courts. Procedural objections raised by respondents are dismissed.
