The defendant's retraction and apology, while commendable, were insufficient to fully mitigate damages due to their timing, content, and lack of full contrition. The defendant's persistent and aggravated conduct after publication, including malicious pleadings and interlocutory applications, warranted a substantial award. The plaintiff was entitled to damages of US$18,000 and ordinary costs of suit.
