Procedural Posture

Urgent Chamber Application / Ruling on Application to Set Aside Warrant of Execution and Return Attached Property

  1. 1 Whether the registration and enforcement of the arbitral award was procedurally proper
  2. 2 Whether notice to the party against whom the award is to be enforced is required
  3. 3 Whether the Registrar or a Judge is the proper authority for recognition and enforcement of arbitral awards

Ratio Decidendi

The recognition and enforcement of an arbitral award must be by application to a Judge of the High Court, not the Registrar, and must be on notice to the party against whom enforcement is sought. Failure to comply with these procedural requirements is fatal and renders the award unenforceable. The warrants of execution issued on the basis of the improperly recognized award were therefore invalid.
