The Clerk of Court erred by applying the Law Society Tariff wholesale to the bill of costs, contrary to the clear provisions of s 43(2) of the Magistrates Court Act and Order 32 r 2(1) of the Rules, which require the use of Table A of the Second Schedule except in exceptional circumstances, which were not demonstrated in this case.
