Procedural Posture

Civil Appeal / Judgment on Appeal From Magistrates’ Court

  1. 1 Whether the best interests of the minor children require a change in custody from the respondent to the appellant
  2. 2 Whether the respondent’s conduct justifies removal of custody
  3. 3 Whether the appellant’s access should be modified or expanded

Ratio Decidendi

The court found that, despite shortcomings on both sides, the respondent has been the primary caregiver and the children have stronger emotional ties with her. The appellant’s concerns about educational neglect were substantiated, but not to a degree warranting a change in custody. The children’s best interests are served by remaining with the respondent, subject to strict monitoring of school attendance and mandatory family counselling. Access for the appellant is deferred until counselling is undertaken.

Court Disposition

Appeal dismissed with costs, subject to conditions.

Orders

  • Respondent declared custodian of the three minor children.
  • Appellant granted access every alternative school holiday and Christmas holiday, conditional on both parties and children attending counselling for at least 6 months.
