The applicant lawfully purchased the property from the 2nd respondent in 1995, paid the full price, and the contract was not cancelled. The 1st respondent was not an innocent purchaser as she had knowledge of the applicant's prior purchase before transfer. The transfer to the 1st respondent was therefore invalid, and the applicant is entitled to the property. Both 1st and 2nd respondents acted with disregard for the applicant's rights and are liable for punitive costs.
