Ratio Decidendi

There was no binding agreement between the beneficiaries to adopt the deceased's invalid will, as not all beneficiaries participated or had capacity, and there was no consensus on the document to be adopted. The estate must be administered in accordance with the Administration of Estates Act as the deceased died intestate. The first defendant's appointment as executor was unlawful as the plaintiff had not been lawfully removed.
