Ratio Decidendi

The court held that while executors must act jointly and the first respondent erred in acting unilaterally, the administration of the estate should not be stayed entirely pending the outcome of the will's validity. The first and second respondents are interdicted from disposing of or distributing estate assets until the appeal over the will is determined, but the collection and safeguarding of assets may proceed. The first respondent is further interdicted from instituting proceedings or disposing of property without the written consent of the first applicant, which consent shall not be unreasonably withheld.
