Procedural Posture

Urgent Chamber Application / Ruling on Application and Reasons for Dismissal

  1. 1 Whether applicants established urgency for interim relief
  2. 2 Whether Masvingo United Residents and Ratepayers Alliance had locus standi
  3. 3 Whether applicants established a prima facie right to relief under sections 76 and 77(a) of the Constitution

Ratio Decidendi

Applicants failed to establish a prima facie right to the relief sought, did not demonstrate irreparable harm, and the balance of convenience did not favor granting the interim order. The evidence showed that the applicants themselves received regular water supply, and the third applicant did not substantiate claims for other residents. The draft order, while imperfect, was not fatally defective, and the use of the wrong form was condoned. The application was therefore dismissed with costs.
