Procedural Posture

Constitutional/administrative Application / Judgment

  1. 1 Whether the applicants' recall from Parliament complied with s 129(1)(k) of the Constitution
  2. 2 Whether the High Court had jurisdiction to hear the matter
  3. 3 Whether non-joinder of the political party (CCC) was fatal to the application

Ratio Decidendi

Applicants lacked standing to challenge their recall without joining the political party (CCC) which alone has the right to recall or contest a recall under s 129(1)(k) of the Constitution. The recall letters from the first respondent satisfied the constitutional requirements, and the applicants failed to prove their entitlement to the declaratory relief sought. Hearsay letters from Nelson Chamisa were inadmissible and did not establish the applicants' case.
