Procedural Posture

Opposed Application for Civil Forfeiture / Judgment

  1. 1 Whether the properties and vehicles in question are proceeds of crime and/or instrumentalities of crime under the Money Laundering and Proceeds of Crime Act
  2. 2 Whether the applicant has established, on a balance of probabilities, that the first respondent acquired the assets using proceeds of theft, fraud, or money laundering
  3. 3 Whether Stand 6940 Southlea Park, Harare is an instrumentality of crime and liable to forfeiture

Ratio Decidendi

The court found, on a balance of probabilities, that the first respondent acquired the Arlington property and three motor vehicles using proceeds of theft and money laundering, and failed to provide a satisfactory, legitimate explanation for the source of funds. The court held these assets to be proceeds of crime and ordered their forfeiture to the State. However, the court found that Stand 6940 Southlea Park, Harare, though used to store some stolen parts, was not acquired or maintained as an instrumentality of crime, and its forfeiture was not justified.

Court Disposition

Application partly allowed; forfeiture of Arlington property and three vehicles granted; forfeiture of Stand 6940 Southlea Park, Harare dismissed; no order as to costs.
