Ratio Decidendi

The lease agreement provided that failure to pay rent on the due date entitled the lessor to cancel the lease immediately without notice. The appellant's breach was failure to pay rent, a material term, and thus the respondent was entitled to cancel without giving fifteen days' notice. No compromise was reached as the deed of settlement was unsigned. The monetary claim for arrears and holding over damages was not supported by evidence and must be set aside.
